How many times does Congress have to stick it to us before we realize that this body politic has no other function than to obey its corporate masters? If you think that you are being represented by these crooks, liars and thieves, then think again. The “Food Safety” bill is alive and has taken so many twists and turns to end up on the verge of becoming law of the land that nobody in his or her right mind could possibly believe that they are not going to cram this garbage down our collective throat no matter what.

And if you thought that good old Sen. Tom Coburn, who had been blocking the legislation would ultimately hold onto what little integrity he could muster and save the day by rescuing us from impending Food Safety doom, think no more. “He lifted his objection at the final moment” (Alexander Bolton), and this travesty of justice was passed in the Senate by unanimous consent.

So, I present to you, unequivocally, the final straw that broke the camel’s back for any sane person relying on Congress to be anything other than what it is; and that is a reeking cesspool of corruption and deceit. It would seem that the only thing to do now is bend over and…well, you know the rest. The House will, quite possibly place the final nail in the coffin on Tuesday.

Food Safety Bill Lives

December 19, 2010 8:39 PM [S.510] A major food safety bill that had almost been given up for dead was suddenly revived in the Senate late on Sunday evening, and may be ready for House approval as early as Tuesday.

In a parliamentary move laid out on the Senate floor by Senate Majority Leader Harry Reid just after 7pm, the Senate took the food safety language that was passed as part of a stop-gap budget plan by the House, attached it to another House-passed bill and approved that by unanimous consent. 

A Democratic Senate aide told me that Republicans did not object to the plan, even though the bill has garnered fierce opposition in some GOP quarters.

The move was a surprise, as it seemed like the Food Safety bill was going to die in the waning days of this year, despite strong support in both the House and Senate.

The bill almost went down the drain originally because of an elementary mistake by Senate Democrats, who added revenue provisions to a measure that originated in the Senate, despite the Constitutional requirement that all spending and revenue bills start in the House.

The House refused to act directly on that legislation, because of what’s known as a “blue slip” problem.

That problem was solved when the House approved its long-term Continuing Resolution last week, which included the language of the Senate-passed food safety bill.

As reported above, the Senate on Sunday night simply took the revised food safety language that was approved by the House in the CR, substituted it to the language of HR 2751, one of the original “Cash for Clunkers” bills from last year, and approved it by unanimous consent.

That move will fix any Constitutional issues, because the plan originated in the House as part of the CR, and by using a bill that was already approved by the House, the Cash for Clunkers bill.

Before you start screaming about that – the food safety language replaces the Cash for Clunkers language in the amended version of HR 2751.

    The Tester Amendment only grants SEPARATE regulations for small farms not EXEMPTIONS!

    Does any one know if the law as passed contains the Commerce Clause?

    The original bill HR 875 contained:

    “in any action to enforce the requirements of the food safety law, the connection with interstate commerce required for jurisdiction SHALL BE PRESUMED TO EXIST.”

    This is the crucial phrase for home raised food.

    The US Supreme Court (The Traitors) found that if a farmer was growing wheat for his own use, he would not be buying it and therefore that affected “interstate commerce” and gave the USDA authority over the farmer. See: Wickard v. Filburn 1942

    This means the following case can be made: If a homeowner is raising a home garden for his own use, he would not be buying it and therefore that affected “interstate commerce” and gives the FDA authority over the homeowner….

    As one lawyer said, it is the words phrases and even punctuation marks that are used to give hidden meaning to laws.

    The question is: how many useless laws and how much ridiculous legislation must be passed until the American sheeple realize they are not being made more safe, but are more in danger, as their personal freedoms are eradicated one by one by their “caring” government nannies? We have become a nation of cowards, fearing every boogie man the government chooses to promote. When will we all realize that the best agent of control is fear, and it is promoted 24/7/365 by the government via the media? Living free never guarantees complete safety, and it is up to all of us to protect ourselves and our personal freedoms before they disappear completely. There is safety living in a cage, until the master in charge decides what is in the cage is worthless and unnecessary. That is where we are now, and the master is the government, that is supposed to be the servant of the people.

    Bill Stoefer is 100% correct, the US is a corporation, the IRS is a for profit organisation based in Puerto Rico. American “citizens” are a commodity of the aforemnentioned corporation and are traded on the open market.     Hi —

    I admit I was surprised at unanimous consent to include the S. 510 language in another bill since I live in Texas and have had correspondance with Sen. Cornyn assuring me he opposes the Food Safety Modrnization Act. In fact, 24 other Senators have also voted against the act and I wondered why any of them would refuse to object to this move.

    I just wrote Sen. Cornyn asking for an explanation. It’s quite possible I’m not familiar with the Senate legislative process and am misunderstanding the meaning of this action.

    It may be there’s another reason that they refused to oppose unanimous consent that doesn’t lead to this act being passed. I can’t imagine how even one of 25 Senators opposed to an act would fail to object to a consent when it would lead directly to the act’s passage. Surely they weren’t all absent from the vote.

    Agreed, this Congress needs a serious lesson in humility.
    Lame Duck sessions need to be “outlawed”. Why are they given an extra two months to rape and pillage after our elections?

    They only and always use these sessions to blatantly expedite “Special Interest” agendas against the “Will’s” just expressed by those same American voters that vote them out of their offices. Lame Duck sessions are criminal intents allowing ridiculous loopholes to be used to subvert the will of the American people.
    While we are at it, we also need to resend their ability to “Vote In” their Own Pay Raises and take away their cushy Retirement Plans and their gold star Health Plans.
    Term Limits Anyone? How about getting together and supporting “State Referendums” on taking back our country from these vermin?

    We all have a moral obligation to disobey unjust and immoral laws. These politicians will end up paying dearly when the peaceful revolution starts.     It is supported by “sustainable” agriculture groups and consumer groups that have sold out and are taking funding from the likes of the Ford Foundation, the Bill and Melinda Gates Foundation, and others. A globalist with “sustainable” lipstick is still a globalist. I suggest you read the bill as soon as we get a copy of it, and go over it with a fine-tooth comb. This bill is another step towards ushering in Codex.

    It is worse than outlawing gardens. It gives the FDA (which has killed more people than infected food) (whose control is a revolving door to big corporations) total control of food & supplements. Frankenfoods(Monsanto)wants total control. If you have animals they can feign an infestation so all private chickens, pigs, cattle, & excreta have to be destroyed. They want to end Farmers Markets. To sell food you have to jump through a lot of hoops. 3 years tax returns & other hoopla. What they don’t tell you, is you are turning over to the powers ownership of your property. You also give up all your rights. They can search & size from you any time of the day or night. A sea of Fascist Nightmares.

    There are some who will tell you farms are specifically exempt from this bill. However that only applies to amended sections of the Food Drug and Cosmetics Act.
    Parts that do concern farmers:
    Sec. 102. (c) (1) (A) amends the definition of “retail food establishment” to include those selling directly to consumers at a roadside stand or farmers’ market.

    The Tester Amendment, which is touted as exempting anyone making less than $500,000 requires those seeking exemption to register with the FDA, provide 3 years of comprehensive financial records (Page 4, line 11) as well as “Documentation that the owner, operator or agent of the facility has identified potential hazards associated with the food being processed, is implementing preventative control to address those hazards and is monitoring the preventative controls to ensure that such controls are effective (Pg. 5 line 20)as well as “Documentation (which MAY include licenses, inspection reports, certificated, permits, credentials, certification by an appropriate agency (such as the State Department of Agriculture) or other evidence of oversight, AS SPECIFIED BY THE SECRETARY (Pg 6 Line 5). Which means the Secretary has the discretion to change the requirements whenever she\he deems fit.
    So I’d have to submit comprehensive plans in order to be exempt from creating them. These plans include how I’ll deal with a terrorist attack on my farm. I also would have to agree to searches of my property any time the FDA decided it is necessary.
    Page 52-53 allows the Secretary to revoke the exemption if “it is necessary to protect the public health and prevent or mitigate a food born illness based on conduct or conditions associated with a farm…. Sounds like a good idea until you look at Sec. 207 Administrative Detention of Food (Pg. 163 Lines 12-16) were “credible evidence or information indicating” is replaced by “reason to believe”. So no proof needed, just the word of a Star Chamber.
    This includes violations of Sec. 419 STANDARDS FOR PRODUCE SAFETY Pg. 42 line 19 “(B) included, with respect to growing, harvesting, sorting, packing, and storage operations, science-based minimum standards related to soil amendments, hygiene, packaging, temperature controls, animals in the growing area, and water.”
    What are these standards? Don’t know ’cause like so many of the other aspects of this bill (including certain penalties) they haven’t been determined yet. What we do know is this also covers seeds saved and stored from previous harvests because seeds may be used as food for humans or livestock. The FDA is already shutting down seed cleaning operations across the nation because they cannot comply with new standards thrown at them.
    And let’s not forget about Sec. 404. COMPLIANCE WITH INTERNATIONAL AGREEMENTS Pg. 239 Line 20 “Nothing in this Act (or an amendment made by this Act) shall be construed in a manner inconsistent with the agreement establishing the World Trade Organization or any other treaty or international agreement to which the United States is a party.
    This is a way to implement Codex Alimentarius which is based on Napoleonic legal code whereby anything that is not explicitly permitted is automatically forbidden. It is designed to control EVERY aspect of how food and nutritional supplements are produced and sold.
    These are just a few of the more obvious problems with this bill.
    Don’t think about how the current administration would use these powers. Imagine instead a president who makes GWBush look like FDR using this power to control the nation’s food supply. Can’t happen? Two years ago who thought TSA agents would be fondling children before they could get on an airplane?
